1.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, particularly the Consumer Protection Act 1999 and its subsidiary regulations. Any dispute arising under these terms will be subject to the jurisdiction of the courts of Malaysia.
2. Orders and Pricing
2.1. Product Information: We will endeavour to ensure that all descriptions, images, and prices of products appearing on the website are accurate. However, we do not guarantee that the product received will be exactly the same as the image shown, as colors and display may vary depending on the device and lighting conditions of the viewer.
2.2. Pricing: The price displayed for a product is the Full Price, inclusive of any applicable Sales Tax or Service Tax (SST), and excludes transportation or shipping costs, unless otherwise stated as ‘Free Shipping’. Any additional costs, such as shipping fees, will be clearly shown at the checkout page before payment is made.
2.3. Order Confirmation: Your order constitutes an offer to purchase the products. All orders are subject to acceptance and availability. A contract of sale is formed only when we confirm to you that the products have been dispatched.
2.4. Rectifying Errors: Before confirming your order during the checkout process, you will be provided with an appropriate means (e.g., a review page) to identify and correct any errors in your order details (e.g., quantity, size, or shipping address).
3. Payment
3.1. Accepted Payment Methods: We accept payment via credit/debit card (Visa, Mastercard), Online Bank Transfer (FPX), and e-Wallets (such as Touch ‘n Go and Boost).
3.2. Payment Security: All payment transactions are secured through industry-standard encrypted payment gateways. We do not store your credit card or sensitive payment information.
3.3. Failure to Pay: If the processing of payment fails, Ascent Store reserves the right to cancel your order.
4. Shipping and Delivery
4.1. Estimated Time of Delivery: The estimated delivery time for your order is 3 to 7 working days for Peninsula Malaysia, and 7 to 14 working days for East Malaysia. This is an estimate and may vary due to unforeseen circumstances or peak seasons.
4.2. Delivery Address: It is your responsibility to ensure that the correct and complete delivery address is provided. Ascent Store is not liable for any losses or delays resulting from incorrect address information provided by you.
4.3. Shipping Costs: All applicable shipping and handling charges will be calculated and displayed during the checkout process.
5. Return, Exchange, and Refund
5.1. The terms governing returns, exchanges, and refunds are outlined in our dedicated Return & Refund Policy, which forms an integral part of these Terms and Conditions. By agreeing to these Terms, you also agree to the Return & Refund Policy.
5.2. Right to Refund (CPA): In the event of a substantial failure of the product to comply with the guarantees under the Consumer Protection Act 1999 (e.g., product is defective, unsafe, or not fit for its purpose), you have the right to seek a refund, replacement, or repair.
6. User Account and Security
6.1. If you register for an account on ascentstore.com.my, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
6.2. Ascent Store reserves the right to terminate accounts, remove or edit content, or cancel orders at our sole discretion.
6.3 You warrant that the information you provide to Ascent Store for the purpose of ordering or purchasing products is complete, accurate, and current. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
7. Intellectual Property
7.1. All content on this website, including but not limited to images, logos, text, graphics, and code, is the property of Ascent Store or its content suppliers and is protected by Malaysian and international intellectual property laws.
7.2. You may not reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the content without express written consent from Ascent Store.
8. Limitation of Liability and Indemnity
8.1. Limitation of Liability: To the maximum extent permitted by Malaysian law, Ascent Store shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the products or the services provided on this website.
8.2. Indemnity: You agree to indemnify and hold Ascent Store harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your breach of these Terms and Conditions.
